Northwest Territories Section 45 Insurance Appraisals
The Northwest Territories Insurance Act provides a contractual appraisal framework that may apply to specified disagreements between the insured and insurer.
Section 45 Establishes a Conditional Appraisal Procedure
Section 45 addresses appraisers selected by the two sides, an umpire and expense allocation. Its use depends on the contract containing an applicable condition that calls for appraisal of the matters in dispute.
“The insured and the insurer shall each appoint an appraiser”Northwest Territories Insurance Act, Section 45(2)
Important distinction: Section 45 is a general insurance-appraisal provision, not a blanket promise of a vehicle appraisal remedy in every NWT claim.
How to Review a Disputed Vehicle Valuation in Northwest Territories
- 01
Confirm the disputed amount
Ask for a written explanation of the vehicle’s current offer and the data behind it.
- 02
Examine the contract
Identify the appraisal condition, applicable coverage and who may initiate the formal process.
- 03
Research the vehicle
Verify exact drivetrain, trim, equipment, kilometres and the availability of realistic replacement vehicles.
- 04
Confirm a suitable assignment
Obtain engagement terms and consider formal appraisal only if the contract and circumstances support it.
What Can Strengthen a Valuation Review?
A limited local supply of comparable vehicles makes it especially important to explain why each external-market listing is a meaningful substitute after considering freight and location.
- The insurer's complete written offer and market valuation report
- Vehicle identification, exact model and trim, options, kilometres and condition
- Listings or other evidence that genuinely match the subject vehicle
- Documentation of material repairs, upgrades or disputed deductions
Confirm Costs Before Formal Appraisal
The statute provides for each party to bear its appointed appraiser’s cost and share the appraisal and umpire expense where the provision applies.
IA Reports can discuss appropriate independent valuation work after confirming assignment scope, availability, authorization and applicable local requirements.
Northwest Territories Valuation Dispute FAQs
Can an appraiser decide whether coverage applies?
Not necessarily. Formal appraisal is for the matters specified by the relevant insurance condition; coverage questions can fall outside it.
Should I accept a quoted value without a report?
It is reasonable to ask for the valuation basis before deciding whether there is a material issue to dispute.
What documents should I request before an independent appraisal?
Start with the complete written offer, the underlying vehicle valuation and the evidence supporting the amount in dispute. Section 45 describes a conditional appointment mechanism, not a general right to challenge every coverage decision.
Disagree With Your Vehicle Insurance Settlement?
Request an initial review of a written total-loss valuation, or ask about an independent appraisal for another defined purpose. We will clarify the assignment scope and any fees before engagement.
